TAS finally makes the RS Berkane jersey decision!

On Wednesday, February 26, the International Court of Arbitration for Sport (TAS) issued its final ruling on the appeal filed by the Algerian Football Federation (FAF) against the Confederation of African Football (CAF) regarding the case of the match between ACB and RS Berkane.

The Court of Sports overturned CAF's decision to approve RS Berkane's shirt, which featured a map of Morocco combined with the disputed territory of Western Sahara. On the other hand, it rejected the Algerian Capital Union's request to cancel the results of the first and second leg matches against the Moroccan team.

In its final report, the TAS recognized that CAF is obliged to respect and implement the principle of political neutrality, but considered that the shirts worn by the Moroccan team in the Confederation Cup contravened CAF regulations.

“The Court of Arbitration for Sport (CAS) issued its final verdict in the case of the match between Etihad Capital and RS Berkane, declaring our club the winner of the case, which validates our legal position and confirms our firm commitment to defend the team's rights in accordance with the applicable laws and regulations.
The court also decided to cancel the decision of the Confederation of African Football (CAF) regarding the qualification of RS Berlkane's jersey, which bore a political symbol in violation of CAF regulations that impose a clear separation between sports and political affairs. This decision is a victory for the principles of fair play and respect for laws, and emphasizes the need for clubs to abide by the regulations of continental competitions.
This ruling reflects the strength and professionalism of the DCU management in defending the club's rights, and highlights its continued keenness to ensure respect for the laws and protect the team's interests in all competitions.

On the other hand, RS Berkane published a statement on its official page confirming that TAS recognized the legitimacy of its qualification to the final of the Confederation Cup, without objecting to the result or imposing any financial penalty.

The statement reads as follows:

“On Wednesday, February 26, 2025, Ennahda Sports Berkane received the decision of the Court of Sports regarding the match between the Union of Algeria and Ennahda Berkane in the semi-finals of the CAF Confederation Cup, which included the rejection of the request of the Union of Algeria to cancel the result of the match back-to-back and to issue a penalty against Ennahda Sports Berkane, where the victory of Ennahda Sports Berkane was approved and no penalty was issued against the club, which pleased our Berkane fans.”
